This Social Media Privacy Notice is based on the General Data Protection Regulation (GDPR). Nevertheless, other data protection laws may apply. Capitalized terms will have the meaning defined in the GDPR unless otherwise specified.
1. Controller for Data Processing
We, Lilium GmbH, Claude-Dornier Str. 1, Geb. 335, 82234 Wessling, registered with the commercial register of the local court (Amtsgericht) Munich under HRB 216921, represented by the managing director Klaus Roewe, operates the social media pages (“Social-Media-Pages”) on the social media networks as indicated below (“Social Media”).
When you visit our Social-Media-Pages, your Personal Data is processed independently by us and by the responsible social media provider as the responsible party, and the respective provider of Social Media assumes the data protection obligations towards you as the user, such as information on data processing, and is the contact person for your rights, as described in this Social Media Privacy Notice.
2. Transmission of Personal Data
Please note that the Social-Media-Page plugins available on the bottom of our Website, available under the URLs https://lilium.com, https://ir.lilium.com, and https://investors.lilium.com (collectively, the “Website”) only provide the links to the correspondent Social Media. No Personal Data is transmitted to these Social Media via our Website unless you click the links to the correspondent Social Media.
By clicking on the plugin button, you will be redirected to our Social-Media-Page made available by the respective Social Media. For this to occur, we may collect cookies in order to connect you to the respective Social-Media-Page and your browser may transmit the IP address of your end-device to the server of the Social Media, as well as the browser’s technical data so that the server can establish the format that the content is to be delivered to that address. Additionally, the browser transmits information relating to the desired content. We cannot control which Personal Data the browser transmits or how your Personal Data is processed by Social Media, as this is not under our responsibility. Evaluations and statistics are generated in the form of page insights from the usage data of the Facebook pages, which support us in improving our marketing activities and our external presence. We may also learn about users and their behavior who interact with or use our Facebook-Social-Media-Page to display relevant content and develop features that may be of interest to them. These page statistics show us, for example, which people from certain target groups interact most with our Facebook Page or which content on the Facebook Page was visited, shared, or liked when and how often. When classifying people into target groups, demographic data, or data about the location of a person is also included in order to place targeted advertisements with these people. If you use Facebook on several end devices, a cross-device analysis of the data can take place. The data collected in this way is statistically processed and usually anonymous, i.e., we cannot establish any reference to the individual person.

We use instagram.com or the mobile app by Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland. When using Instagram, if you have an account there, Instagram can assign your activities to your profiles there. We use tiktok.com, or mobile app by TikTok Technology Limited, which is a company registered in the Republic of Ireland with its registered office at 10 Earlsfort Terrace, Dublin, D02 T380, Ireland and company number 635755 for our external digital presentation, including enhancing our external presence, advertising, recruiting and employer branding, and marketing activities. If you agree to be featured on Lilium’s TikTok business profile, your data (incl. image, photo, or video) will be processed by TikTok and may be transferred to and hosted by a third country without an adequacy decision, such as Malaysia and Singapore. Additionally, TikTok is part of ByteDance Ltd., with the address at P.O. Box 31119 Grand Pavilion, Hibiscus Way, 802 West Bay Road, Grand Cayman, KY1 - 1205 Cayman Islands.

4. Data Processing Purposes and Legal Basis
With our Social-Media-Pages, we can communicate with you and provide you with interesting information. We may receive further data from you through your comments, shared images, messages, and reactions, which we then process to answer or communicate with you. If you use Social Media on several end devices, a cross-device analysis of the data can take place. The legal basis for this processing is based on our legitimate interest in improving our presentation to the outside world, public relationship, and communication (Art. 6 (1) lit. f GDPR). If you are accessing our Social-Media-Page via the plugin on our Website, we may collect cookies and other data in order to connect you to the respective Social-Media-Page. The legal basis for processing is your consent (Art. 6. (1) lit. a GDPR). You can withdraw your consent with regard to the processing activity on our Website at any time by accessing our Cookie preference tool– [show Cookie preference tool].

5. Data Processing outside the European Union (EU)
If you are located in the European Union (EU), note that when using Facebook, Instagram, Twitter, LinkedIn, or YouTube, the processing of Personal Data may also take place in a third country for which there is no adequacy decision by the European Commission. Therefore, the level of protection customary for the GDPR cannot be guaranteed during transmission, as it cannot be ruled out that in third countries, e.g., authorities can access the Personal Data collected. We do not have influence over such access and any further processing by third parties, including by the Social Media provider.
If your Personal Data is transferred to countries outside the EU, the Social Media provider regularly provides appropriate guarantees, e.g., by concluding the Standard Contractual Clauses issued by the European Commission, or by adhering to approved Binding Corporate Rules to ensure that the transfer of data takes place with the same level of data protection that corresponds to the GDPR. If not publicly available, we can grant you a copy of the respective appropriate guarantees or provide further information where they have been made available to us.
6. Your Rights and Objections; Contact Details
If you are located within the EU, in accordance with applicable statutory provisions, you, as the data subject, have the right to receive information about your Personal Data stored by the controller free of charge. Additionally, you can assert your rights to correction, deletion, or restriction of the processing or the right to object. This also applies to your right to receive your Personal Data in a structured, current, and machine-readable format or, if applicable, to request the transmission to another person responsible (data portability). If you have provided Personal Data on the basis of consent, you can withdraw such consent at any time, being that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
As explained above, these aforementioned rights must be exercised directly through Facebook, Twitter, LinkedIn, YouTube, or Instagram, respectively. This follows from the fact that such a provider has direct access to the relevant information on the Social-Media-Page and the processing of your Personal Data. However, you are also welcome to contact us by sending an email to email@example.com. In this case, we will also take reasonable steps, considering available technology and the means available to us, to inform the responsible social media provider that is processing your Personal Data of your request.

We will store your Personal Data in Sprout Social, as a centralized tool for management, and analysis of our Social-Media-Pages, using the criteria of whether the Personal Data is still required for the purposes as described in this Social Media Privacy Notice. If a Social Media post (or other types of message) is deleted on a social network, Sprout Social has downstream processes in place to effectuate that deletion request in its platform.
Lilium will also take reasonable measures, considering the circumstances, to inform all relevant Social Media providers in case you have requested from us the deletion of your Personal Data in one or more of our Social-Media-Pages.
Your Personal Data may also be stored if you contact us directly or if we contact you via specific social media (e.g., for recruitment purposes via LinkedIn). In this case, your Personal Data will be deleted as soon as the purpose is achieved, considering legally mandated retention periods.

8. Changes to this Privacy Notice
We may update this Social Media Privacy Notice periodically. As such, you should review this page periodically. When we change this Social Media Privacy Notice in a material way, we will update the “last modified” date at the end of this Social Media Privacy Notice. Changes to this Social Media Privacy Notice are effective when they are posted on the Website.
